Real Decreto 178/03 Entry and permanency in Spain of the Citizens of CEE

The main change introduced by the new regulations is that you are not obligated to have a Residence Card, as your own country Identity Card or Passport will be valid in the following cases:
-Workers ,students or any other grants of permanent residence.
-Family of the people above(if the family is from a CEE Member Country).
-People working in Spain but have their residence in another CEE Member Country, where they return back almost everyday.
Even if you are included in any of the above cases, you are entitled to apply for a residence card.
If you wish to claim any Government benefit or financial aid (Study or employment)you are entitled to that, in the same conditions as Spanish Citizens.
The second important change is the application for a permanent residence:
-Workers finishing his activity in Spain and are under the Spanish retirement age limit. You need to have worked in Spain for the last 12 months, and demonstrate more than 3 years Spanish residence.
-Workers who get a Temporal Incapacity for work, and have residence longer
than 2 years without interruption. You don't need to demonstrate anything if
the Incapacity is work related.
-Workers in another Member Country but with residence in Spain for more than 3 year.
